This version is not yet part of a purchase or usage agreement. Before distribution, it must be aligned with the game version actually supplied, the platform terms and any promised online services, and validly incorporated into the relevant agreement. 1. Licensor and subject matter
The licensor is Patrick Hackl, trading as HACKLWORKS, Vogelkammweg 3, 94518 Spiegelau, Germany, info@hacklworks.de. Once validly incorporated, this agreement governs the use of a copy of PESTBOUND lawfully acquired or supplied by the licensor, including associated updates, except where separate terms apply to individual components.
The product information agreed when the contract is concluded determines the specific scope of the product purchased. This EULA does not by itself specify a release date, a particular server operating period or a minimum level of availability.
2. Permitted use
You receive a non-exclusive right to install and use the lawfully supplied copy for your own private gameplay in accordance with the relevant offer. The chosen platform’s technical installation and account requirements also apply where validly agreed. The duration of your entitlement is determined by the offer purchased; this EULA does not convert a licence sold for an indefinite period into a subscription.
Backup copies, observation and examination of the program, interoperability measures and other acts permitted by mandatory law remain allowed. Rights under Sections 69d, 69e and 69g of the German Copyright Act (UrhG), and applicable statutory exhaustion principles, are not excluded.
3. Prohibited interference and third-party rights
Without the necessary permission, protected game content must not be distributed or sold as your own product or used to create infringing copies. Deliberately circumventing effective access protections, distributing malicious software and attacking other people’s game accounts or servers are prohibited unless permitted by law. Lawful modifications or analysis are not prohibited solely because of their technical form.
Components with their own licences, such as open-source software, remain subject to those licences. The required notices will be supplied with the relevant version of the game. This EULA does not grant transferable music or trademark rights in third-party materials.
4. Online features and conduct
Whether and to what extent a specific version requires internet access, a platform account or a server must be stated in the product description before purchase. Additional binding server rules and any moderation measures must be made transparent before they are applied. This EULA does not create an undisclosed power to arbitrarily revoke a lawfully acquired licence.
When using online features, you must not threaten others, deliberately harass them or harm them through unlawful content. Interference that manipulates intended gameplay to give other players an unfair disadvantage is prohibited. Statutory rights in the event of an unjustified access restriction remain unaffected.
5. Updates, changes and defects
Updates required by law, including security updates, and agreed product characteristics remain owed. Their scope and duration are determined by the contract and applicable law. Changes to digital products that go beyond maintaining conformity with the contract are permitted only under the applicable legal and contractual conditions.
Your statutory rights concerning defects in digital products remain unaffected, including, where applicable, the right to have the product brought into conformity, a price reduction, termination of the contract and damages. Where another provider is your contractual counterparty for the purchase, your claims against that provider also remain intact. This EULA does not supply the game under a blanket exclusion of all warranty rights.
6. Termination and liability
You may stop using the game at any time. Whether and under what conditions an underlying agreement may be terminated depends on its terms and the applicable law. Termination for a serious breach must meet the legal requirements, including any necessary prior warning or opportunity to remedy the breach.
Statutory liability rules apply. Mandatory claims, particularly for death, personal injury or harm to health, under product liability law, or arising from intentional misconduct or gross negligence, are not excluded or restricted.
7. Privacy and applicable law
The processing of player, account, diagnostic or server data must be described in separate privacy information before the relevant feature is provided. This EULA does not constitute consent to telemetry, advertising or other optional data processing.
Where a choice of law is validly agreed, German law is intended to apply. Consumers do not thereby lose the protection of mandatory provisions of the country of their habitual residence where those provisions apply by law. No exclusive jurisdiction agreement to the detriment of consumers is made here.
